Terms of Service
The agreement between you and CurbTech AI for using the platform.
Last updated: August 26, 2026
These Terms of Service ("Terms") govern your access to and use of CurbTech AI ("CurbTech," "we," "us," or "our") and any related services, websites, and applications. By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.
Plain language summary: CurbTech AI gives you software tools to find business opportunities, understand companies, run outreach, manage customers, and handle business documents. You are responsible for how you use those tools and the information you obtain through them. We do not guarantee business results.
1. The Platform
CurbTech AI provides software tools for business growth, including lead discovery, business intelligence, email outreach, CRM, website building, proposals, invoices, and related business operations. The platform is a "Business Growth Operating System" — not a lead delivery service. You use the tools; we provide the infrastructure.
2. User Responsibility
You are responsible for how you use the platform and the information you obtain through it. You are responsible for the accuracy of anything you send, publish, or rely on. CurbTech does not operate your business for you and is not a party to any relationship you form with businesses or contacts found through the platform.
3. Lead & Business Data
CurbTech AI may aggregate publicly available business information from directories, websites, maps, social profiles, and similar public sources.
- Lead information may be incomplete, outdated, incorrect, or unavailable.
- CurbTech does not guarantee that every business record or contact detail is accurate or current.
- You should independently verify important information before relying on it or acting on it.
- The platform does not fabricate contact information. Where contact details cannot be verified from public sources, fields are left empty rather than guessed.
4. Contacting Businesses — Legal Compliance
Users are responsible for complying with all applicable laws and platform policies when contacting businesses. Depending on where you and your recipients are located, this may include:
- CASL (Canada's Anti-Spam Legislation) — requires consent, sender identification, and a working unsubscribe mechanism for commercial electronic messages sent to recipients in Canada.
- CAN-SPAM Act (United States) — requires accurate headers, a physical postal address, clear identification, and an opt-out mechanism for commercial email.
- TCPA (Telephone Consumer Protection Act, United States) — restricts calls and text messages without prior express consent, including automated or prerecorded messages.
- GDPR (European Union) and similar privacy regimes — may require a lawful basis and, in many cases, consent before processing or contacting individuals in covered jurisdictions.
- PIPEDA (Canada) and CCPA/CPRA (California) — govern how personal information is collected, used, and shared.
You must obtain any consent required by law before contacting a person or business, honor opt-out and unsubscribe requests promptly, and respect "do not call" registries and similar restrictions. CurbTech does not provide legal advice; if you are unsure whether your outreach complies with applicable law, consult a qualified lawyer.
5. Email Sending
CurbTech AI integrates with email providers (such as Gmail via OAuth) to send messages on your behalf. Users are responsible for:
- Email content and accuracy
- Recipient selection and targeting
- Consent and legal requirements where applicable
- Including and honoring unsubscribe mechanisms
- Sending practices and volume
- Domain authentication (SPF, DKIM, DMARC) where applicable
- Provider-specific restrictions and terms
CurbTech AI does not guarantee inbox placement, open rates, replies, conversions, or any campaign outcome. Deliverability depends on your sender reputation, content, recipient engagement, and your email provider's own filtering — none of which CurbTech controls.
6. Artificial Intelligence
The platform uses AI to generate summaries, emails, proposals, business descriptions, job descriptions, marketing copy, and other content. AI-generated content may contain errors, omissions, or outdated information. You should review all AI-generated content before relying on or sending it. You are responsible for the final content you send or publish.
7. Third-Party Services
The platform may interact with third-party services such as Google, Gmail, Maps, email providers, business directories, social networks, and payment providers. The availability, accuracy, and functionality of these third-party services are outside CurbTech's control. Changes to a third-party service may affect features of the platform without notice.
8. Accounts & Security
You are responsible for maintaining the security of your account, including your password and any connected integrations. You must not share credentials or attempt unauthorized access to any account, system, or data. You must be at least the age of majority in your jurisdiction to create an account.
9. Prohibited Use
You agree not to use the platform to:
- Break any applicable law or regulation
- Commit fraud or misrepresentation
- Send spam, unsolicited commercial messages without required consent, or communications that violate anti-spam or telemarketing laws
- Harass, threaten, or abuse any person or business
- Attempt unauthorized access to systems, accounts, or data
- Scrape data in a way that violates the terms of the source website or service
- Distribute malware or malicious code
- Impersonate another person or business
- Attempt to bypass platform usage limits, paywalls, or billing systems
- Resell or sublicense access to the platform without permission
Violation of these rules may result in suspension or termination of your account without refund.
10. Operator Pass
Operator Pass is a one-time $100 CAD purchase that provides lifetime access to the limits and features advertised at the time of purchase.
- Operator Pass is not a subscription and carries no recurring billing.
- It unlocks larger Lead Engine generation packages (35, 75, or 100 leads per generation, versus 8, 15, or 25 for free accounts) and increases other advertised limits (email, invoices, websites). Both free and Operator Pass accounts may run the Lead Engine without a daily generation cap.
- Operator Pass entitlement is granted only after a payment provider confirms a successful transaction server-side. Checkout redirects, button clicks, or client-side state alone do not unlock entitlements.
- Third-party provider limits (such as your email provider's own sending caps) still apply and are not overridden by Operator Pass.
- Features added or changed after your purchase are not automatically guaranteed unless explicitly stated at the time of purchase.
- CurbTech may modify platform features, limits, and pricing for future purchasers; your purchased limits are those advertised at your time of purchase.
11. Usage Limits
CurbTech AI enforces usage limits on free and Operator Pass accounts. Signed-in free users may run the Lead Engine without a daily generation limit using the 8, 15, or 25 lead packages; Operator Pass unlocks the 35, 75, and 100 lead packages. Guest (unauthenticated) users cannot use lead generation. Limits are tracked per authenticated user and are designed to keep the platform stable and fair. Attempting to circumvent limits (for example, by creating multiple accounts, manipulating client-side state, or calling backend functions directly) is a violation of these Terms.
12. Payments
Payments are processed by third-party payment providers (such as Stripe). CurbTech does not store full card numbers. Prices are listed in Canadian dollars unless otherwise stated. One-time purchases (such as Operator Pass) are charged once; subscriptions, where offered, recur until cancelled according to the provider's terms.
13. Refunds
Refund eligibility depends on the nature of the purchase and applicable consumer protection law. Because Operator Pass immediately unlocks platform capabilities, refund requests are reviewed on a case-by-case basis. Where a statutory right to a refund applies, that right is preserved. To request a refund, contact CurbTech support.
14. Changes to the Platform & Terms
CurbTech may modify the platform, features, limits, pricing, and services over time. Material changes to these Terms will be communicated appropriately (for example, via the platform or by email to registered users). Continued use after changes take effect constitutes acceptance of the updated Terms.
15. Disclaimer
CurbTech AI provides software and information tools. It does not guarantee:
- Business revenue, profit, or growth
- Lead conversion, reply rates, or deal closure
- Employment or job placement
- Campaign performance, open rates, or click-through rates
- Email delivery or inbox placement
- Website traffic, search rankings, or customer acquisition
- Investment returns
- Any specific business outcome
The platform is provided "as is" and "as available." You use it at your own risk.
16. Limitation of Liability
To the maximum extent permitted by law, CurbTech's total liability arising out of or relating to these Terms or your use of the platform is limited to the amount you paid to CurbTech in the twelve months preceding the claim, or one hundred Canadian dollars ($100 CAD), whichever is greater. CurbTech is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, except where such limitation is prohibited by law.
This limitation does not apply to liability that cannot be excluded under applicable law (such as liability for gross negligence or willful misconduct in some jurisdictions).
17. Termination
You may stop using the platform at any time. CurbTech may suspend or terminate access if you violate these Terms, if your account is inactive for an extended period, or to protect the platform. Upon termination, your right to use the platform ends; data you created may be deleted according to our retention practices.
18. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of Alberta, unless you and CurbTech agree otherwise in writing.
19. Contact
Questions about these Terms can be directed to CurbTech support through the platform's contact page or by email. We are based in Alberta, Canada.
